The Family Court Bench Book
Dear Visitor
As promised we are continuing to review the Family Court
Bench Book to ensure that it remains a useful and up-to-date resource. On this
occasion the landmark decision of McFarlane J in Re X has resulted in
important guidance that we have included in this second update.
Because we are currently conducting a major review of the
Family Court Bench Book this update is only being published electronically.
Nevertheless we believe that this update is too vital to be left until that
review could be completed. The filing instructions that follow this letter
make it clear which sections of the book need to be replaced. If your
Justices’ Clerk has not provided them, these can then be printed from our
website (www.jsboard.co.uk) and
inserted into your Bench Book at the appropriate place. If you have any
further suggestions, comments or queries about the Bench Book please contact
the JSB direct.

only; they are not intended to lay down or develop any principles of family
law, but to reflect the law as it stands at any given time. By viewing or
